A.C.A. ยง 12-12-903 ย defines the offenses that require registration. Some of the following offenses may seem repetitious, however they are provided as a complete listing as specified by law.
- Rape, ยงย 5-14-103;
- Sexual indecency with a child, ยงย 5-14-110, if the offense is a felony;
- Sexual assault in the first degree, ยงย 5-14-124;
- Sexual assault in the second degree, ยงย 5-14-125;
- Sexual assault in the third degree, ยงย 5-14-126;
- Sexual assault in the fourth degree, ยงย 5-14-127;
- Incest, ยงย 5-26-202;
- Engaging children in sexually explicit conduct for use in visual or print medium, ยงย 5-27-303;
- Transportation of minors for prohibited sexual conduct, ยงย 5-27-305;
- Employing or consenting to the use of a child in a sexual performance, ยงย 5-27-402;
- Pandering or possessing visual or print medium depicting sexually explicit conduct involving a child, ยงย 5-27-304;
- Producing, directing, or promoting a sexual performance by a child, ยงย 5-27-403;
- Promoting prostitution in the first degree, ยง 5-70-104;
- Stalking, ยงย 5-71-229, when ordered by the sentencing court to register as a sex offender;
- Indecent exposure, ยงย 5-14-112, if a felony level offense;
- Exposing another person to human immunodeficiency virus, ยงย 5-14-123, when ordered by the sentencing court to register as a sex offender;
- Kidnapping pursuant to ยงย 5-11-102(a), when the victim is a minor and the offender is not the parent of the victim;
- False imprisonment in the first degree and false imprisonment in the second degree, ยงยงย 5-11-103ย andย 5-11-104, when the victim is a minor and the offender is not the parent of the victim;
- Permitting abuse of a minor, ยงย 5-27-221, if the abuse of the minor consisted of sexual intercourse, deviant sexual activity, or sexual contact;.
- Possession or use of child sexual abuse material, ยงย 5-27-603;
- Computer exploitation of a child, ยงย 5-27-605;
- Permanent detention or restraint, ยงย 5-11-106, when the offender is not the parent of the victim;
- Distributing, possessing, or viewing of matter depicting sexually explicit conduct involving a child, ยงย 5-27-602;
- Internet stalking of a child, ยงย 5-27-306;
- Crime of video voyeurism, ยงย 5-16-101, if a felony level offense;
- Voyeurism, ยงย 5-16-102, if a felony level offense;
- Any felony-homicide offense under ยงย 5-10-101, ยงย 5-10-102, or ยงย 5-10-104ย if the underlying felony is an offense enumerated as #1 through #31.
- Sexually grooming a child, ยงย 5-27-307;
- Trafficking of persons under ยงย 5-18-103(a)(4);
- Patronizing a victim of human trafficking, ยงย 5-18-104; and
- Sexual extortion, ยงย 5-14-113;
- An attempt, solicitation, or conspiracy to commit any of the offenses enumerated as #1 through #31.
- An adjudication of guilt for an offense of the law of another state: Which is similar to any of the offenses enumerated as #1 through #31or When that adjudication of guilt requires registration under another state’s sex offender registration laws; When that adjudication of guilt requires registration under another state’s sex offender registration laws;
- A violation of any former law of this state that is substantially equivalent to any of the offenses enumerated as #1 through #31.
- An adjudication of guilt for an offense in any federal court, the District of Columbia, a United States territory, a federally recognized Indian tribe, or for a military offense: Which is similar to any of the offenses enumerated as #1 through #31. When the adjudication of guilt requires registration under sex offender registration laws of another state or jurisdiction; orย If the conviction was for a violation of: 18 U.S.C. ยง 2252C; or 18 U.S.C. ยง 2424; or 18 U.S.C. ยง 2425;
- An adjudication of guilt for an offense requiring registration under the laws of Canada, the United Kingdom, Australia, New Zealand, or any other foreign country where an independent judiciary enforces a right to a fair trial during the year in which the conviction occurred.
