EPCRA sections 311-312: Hazardous Chemical Inventory Reporting
- Facilities handling or storing hazardous chemicals above the Threshold Planning Quantity (TPQ) must provide all Safety Data Sheets (SDS) to the State Emergency Response Commission (SERC), Local Emergency Planning Committee (LEPC), and local fire departments.
- Facilities must provide an annual inventory report to SERC, LEPC, and local fire departments in the form of a Tier II Report due on March 1 of each year.

Fees
- $50.00 for first three chemicals, $10.00 for each additional 3 chemicals (or portions thereof) and a ceiling per location of $1,000.00.
- Examples:
- 1 Facility – 1 Chemical = 50.00
- 1 Facility – 3 Chemicals = 50.00
- 1 Facility – 4 Chemicals = 60.00
- 1 Facility – 7 Chemicals = 70.00

TIER II FAQs
What are Arkansas’ Tier II reporting requirements?
- In Arkansas, Tier II reports are submitted annually to ADEM only & ADEM distributes to Local Emergency Planning Committees (LEPC) and fire departments
- Tier II reports must be submitted electronically to ADEM via the Tier II Submission Form. No paper forms will be accepted
- Tier II reports must be prepared using the latest version of EPA software Tier2Submit
- When Exporting from Tier II Submit, choose:
- Create another kind of export file (ZIP, PDF, or KML) to back up your data,
- Create a ZIP file containing an XML file that adheres to the national Tier II standard
- Oil and Gas Exploration and Production Industries:
- On October 9, 1997, the State Emergency Response Commission declared each lease (as recorded with the Oil and Gas Commission) to be recognized as a ‘facility’ thus, requiring a Tier II report and fee to be filed for each lease/facility. The fee for submitting the Generic Hazardous Chemical List, a listing of over 200 chemicals, will be capped at $200.00 per lease/facility. Be sure to include a completed and signed Tier II form with the Generic List.
Tier II Reporting: Am I Regulated?
Find out if you need to report hazardous chemicals that you store at your facility.
- A chemical is hazardous if the facility is required to maintain Material Safety Data Sheets (MSDS) or Safety Data Sheets (SDS) under the Occupational Safety and Health Administration (OSHA) regulations.
Am I Required to Report Stored Chemicals?
Tier II reporting is required for any facility that stores hazardous chemical(s) that meet or exceed chemical thresholds at any one time.
Hazardous Chemical Reporting Thresholds
If you store hazardous chemicals in quantities equal to or greater than the reporting threshold for that chemical you must submit a Tier II Report.
Reporting Thresholds
- Hazardous chemicals: 10,000 lbs.
- Extremely hazardous substances (EHS): 500 lbs. or the threshold planning quantity (TPQ), whichever is less. (Please see the following link: EHS List of Extremely Hazardous Substances and TPQs.)
