Tier II Reporting

The Emergency Planning and Community Right-to-Know Act (EPCRA) was established to help communities plan for potential chemical emergencies. By requiring industry to report on the use, storage, and release of hazardous substances, state governments and local communities can use this information to prepare for potential risks. Facilities containing chemicals at or above EPA thresholds must submit a chemical inventory (a Tier II report) to the state on an annual basis. This information must also be made available to the public.
In Arkansas, ADEM acts as the state’s central repository for Tier II information. Facilities electronically submit Tier II reports each year, and ADEM distributes them to Local Emergency Planning Committees (LEPCs) and fire departments statewide. Tier II reports are used by LEPCs to develop response plans for hazardous material spills or natural disasters. Fire departments use Tier II reports to pre-plan incident response; as well as prepare personnel for any chemicals or hazards that may be present when responding to emergencies.

Facilities handling or storing hazardous chemicals above the Threshold Planning Quantity (TPQ) must provide all Safety Data Sheets (SDS) to the State Emergency Response Commission (SERC), Local Emergency Planning Committee (LEPC), and local fire departments.

Facilities must provide an annual inventory report to SERC, LEPC, and local fire departments in the form of a Tier II Report due on March 1 of each year.

    TIER 2 Resources

    All TIER 2 Reporting Submission will be through the HazConnect Program.

    Facilities need to register as a “Reporting Facility/Business User”. Complete all the required fields on the User Account Details page. If you have filed Tier 2 reports in the past using the Tier 2 submit program, you must provide the names and addresses of those facilities in the box labeled “Facility Details” at the bottom of the page so these can be associated with your user account. This process will take place when your account is approved.

    NOTE: Only one user account can be associated with a facility, so if there are other persons within your organization that provide input on your Tier 2 reports they must manage that information through the same user account.

    If you need to file Tier 2 reports for a new facility, or a facility that has not previously reported, you will be able to add those facilities after your account is approved and you are logged in.

    TIER 2 Reporting Fee Structure for 2025 Reporting Year.

    $50.00 for the first reportable chemical and $10.00 or each additional chemical. A maximum of $1,000 per facility is assessed. Per Arkansas Law, Tier 2 Reports must be submitted and fees paid by March 1 of each year or late fees will be assessed.

    Federal, State, County and Municipal Facilities – No fee required, but full reporting is mandatory.

    What is Arkansas’ TIER 2 reporting requirements.

    HAZCONNECT Program provides access of TIER 2 data to local officials/LEPCs and Fire Departments.

    Tier II reports must be submitted electronically through HAZCONNECT. No paper forms will be accepted.

    On October 9, 1997, the State Emergency Response Commission declared each lease (as recorded with the Oil and Gas Commission) to be recognized as a ‘facility’ thus, requiring a Tier II report and fee to be filed for each lease/facility. The fee is $200.00 per lease/facility.

    Tier II Reporting: Am I Regulated?

    A chemical is hazardous if the facility is required to maintain Material Safety Data Sheets (MSDS) or Safety Data Sheets (SDS) under the Occupational Safety and Health Administration (OSHA) regulations.

    Hazardous Chemical Reporting Thresholds

    If you store hazardous chemicals, anytime of the calendar year, in quantities equal to or greater than the reporting threshold for that chemical you must submit a Tier II Report.

    Hazardous chemicals: 10,000 lbs.

    Extremely hazardous substances (EHS): 500 lbs. or the threshold planning quantity (TPQ), whichever is less. (Appendix A to Part 355—The List of Extremely Hazardous Substances and Their Threshold Planning Quantities)
